This is somewhat of an old story, but CNN radio was broadcasting it on my way home for the weekend.
African American Genarlow Wilson was sentenced to 10 years in jail for having sex at a New Years Eve party with a 15 year-old, when he was 17 years-old. Now, since the law is on the books – I am not going to argue that the prosecutor was unjust in going after Wilson – the prosecutor was just doing his job; however, the Georgia state legislature passed a law that made Wilson’s felony into a misdemeanor, but they didn’t make it retroactive.
So now, anybody else who commits statutory rape will be charged with a misdemeanor, while Wilson sits in jail for 10 years.
In my opinion, this is an area where the government has to relax regulations – they don’t have a place in the bedroom, as long as it truly is consensual. I think a 14 and a 16 year old should be able to have sex, as should a 16 and 18, or 17 and 19. If you’re both under 18, and at least 14, you should be able to have sex. If you’re 18 or older, I say that your partner can’t be more than 2 years younger.
And violations of this should just be monetary fines without the person going on a sex offender list.
Wilson should be let go, because he’s already served enough time for what he did. What he did was stupid, but not deserving of 10 years in jail.
